In general lines this law 12.305, aims to implement 5 Rs (Reduce, Reuse, Recycle, Re-educate and Replan) concept in Brazil. It a sets out a Solid Waste National Policy, which also requires that all entities that generate identified types of hazardous waste (e.g., those related to mining and industrial activities, construction, transport systems, health services and sanitation), develop and report a solid waste management plan. Provisions on mandatory information disclosure include: a diagnosis of the waste produced or managed by the organization and the environmental liabilities it has incurred, waste management operational procedures, preventive and corrective actions, and reduction and recycling goals. Complete and updated data is to be provided to the competent body of the state administration and is taken into account either during environmental licensing or by the competent municipal authority.
