Law N 12.305 Solid Waste National Policy

Law no. 12.305 sets out a Solid Waste National Policy, which requires that all entities that generate identified types of hazardous waste, develop and report a solid waste management plan.

E.g. types of entities: those related to mining and industrial activities, construction, transport systems, health services and sanitation. Provisions on mandatory information disclosure include: a diagnosis of the waste produced or managed by the organization and the environmental liabilities it has incurred, waste management operational procedures, preventive and corrective actions, and reduction and recycling goals. Complete and updated data is to be provided to the competent body of the state administration and is taken into account either during environmental licensing or by the competent municipal authority.
